What happens when an employer lies to unemployment insurance?


I got a paper in the mail my formal employer is appealling my benefits. The info as to why is clearly wrong this appeal shouldn't take but a few mintues.

Is there any law against them for lying not to pay umemployment. Because if i lied I would be fine or prosecuted, should they have the same standard?

The employer always gets the case denied. The results are the appeal. You need to go to the appeal. They will believe the employer first since the employer pays unemployment insurance and kind of knows the right words to say.

At the appeal, bring any documentation with you. Also, bring any kind of hand book or policies the company has. You will need to say why exactly you were fired. Did you know and were aware that what you were doing was grounds for termination? Did they give you warnings and steps to take in the future to prevent you "screwing" up? Did they ever do a performance appraisal and tell you what areas you were messing up in? You have a good chance of getting unemployment, depending on what your were fired for. I believe you, I'm sure they 'stretched' the truth. All they do is have a brief phone conversations with someone from Unemployment and discuss why you were fired. That's why you were denied. Appeal it. Bring witness, paperwork, anything you have to help you. If you can prove they lied, even better for you.

Of course your employer will be in trouble if lying, but who will tell? If you can lose from it you should say something about it. you have the opportunity, which is why I guess they sent you the copy.
If there is a hearing for the appeal, you should go. If it is on paper you should write a simple letter saying the employers statement is untrue, and send it or take it to the same place the employer has written to.Protect yourself.

You can appeal the decision and have a hearing. Be sure to have a lawyer with you when you go to the hearing, it will be worth it, trust me on this one. Been there.

Until you have the hearing, it is a "your word vs. their word" kind of a thing.
