What's my chance of winning amy appeal against my former employer?


Ok Now this is the story, my sister was staying with me briefly she is my twin, I was trying to help her get on her feet, she is having some issues, and I thought that I could be of some assistance. I came home from lunch to retrieve my mail, and she had already taken it. The mail had my paycheck in it. I called my HR and ask if they will place a stop pay on the check and they did. I reeceived a replacement check.

My sister didn't come home that night so I knew that she had taken my pay check, she called me two days later to tell me that she cashed my check and that she relasped.
I then the very next day took out a hardship withdrawl from my 401k to repay the funds back to the employer. I got called into a meeting and they asked me what happend and I told them that my sista had taken my check etc..Which the man didn't beleive me. He said that if I paid the funds back the next day that I wouldn't be terminated. I told him that I would be able to pay it back that thursday he said ok. I actually was able to borrow the funds from my dad, but before the end of the bussines day the following day I was terminated.

I filed for unemployment, and they denied it based off what my employer stated. I decided to appeal the decision. I sent in information supporting I have a twin sister. My mother wrote a letter stating that she have twin daughters gave both our socials, and had the letter notorized. I sent in her high school diploma, and some other things.
I also sent in some info from the website and my old job, from when you do a stop pay on a chck it states that if both checks are cashed that the funds will be garnished from the employees payroll. Nothing about termination of employment

You have less of a chance to win on appeal than you did initially, but some appeals do win, so go for it.

It certainly sounds to me like a wrongful termination.
Contact the Labor board or state attorney's general office and find out what your options are.

the old "my twin sister did it" story will not hold water.

Some states can fire you for any reason I was in SC & did file an appeal I stuck to my guns & did win. They have to pay me for all the time owed In addition I got an added suprise because under new guidelines signed last month from Pres. Bush because I am still not working I will receive extra 12 weeks until I find a job. Just document everything & try to get noterized statements from other people you worked with.
