Appeals court now what happens?


hello, in appeals court about how long do you have to wait for an appeal date [probate] i was found in favor for but now the other party has appealed ,about how long do we wait for a court date ? do we have to bring back witnesses or do they just use the manuscripts ,evidence already provided? thank you

thank you, so much ,we went to court and had a lot of evidence as well as witnesses one of which came from washington [we are in fl.] only the opposing attorney was at hearing ,no evidence or witnesses ,I have never been through such a thing in my life

You might try logging on to the appeal court's web site for the rules & deadlines. After a notice of appeal is filed the appellant usually has a certain number of days to furnish a transcript & then a certain number of days after that to file its brief. Then the appellee files a reply brief & then the appellant usually has the right to file a response to the reply brief. Then the court may or may not set a case for oral argument & after that the court will take its time to render an opinion. There will normally not be additional evidence. OR the court may just dismiss the case for any of a hundred reasons; or the parties may settle; or the court may remand the case to the trial court for additional proceedsings or even additional testimony & then the whole process may start over.
