How does the "Three Strikes Law" effect one with one prior conviction?


My fiance' had one prior strike, and was convicted of armed robbery, which he didn't commit. The judge gave him two strikes for this one offense (I guess one for robbery and one for being armed) giving him a total of three and now he's serving a life sentence. Is this a good cause to appeal?

Hes in deep now. His Lawyer should have struck the prior, made them prove and plead the priors as well as appealing and vacating his last plea deal. Hes in for a long time no matter how it goes.

If he is serving a life sentence then the third strike is a mute point!
