According 2 the Indian Muslim Marraige Act if wife appeals 4 Khulaa can she claim?Wat about the childs custody |
She was outside India with her husband and due to her ill-nature and aggression she left the house went wit her brother somewhere and then flew away to India witout her husbands consent or knowledge leaving her 4months old kid there?After landing there she blamed that her husband had tortured and tried to kill her. Also that he snatched away the baby from her and kicked her out of the house which was all a false game to cover her sins. She left no way out in degrading the families repute, dignity and respect back in homeland. Also she along wit her parents broke open her mother-in-laws apartment and started to live there. Till how far is this correct and is she rite in all her acts?With respect to all this her husband and family members have still taken no action so as to maintain some dignity.What can be done here?And the biggest issue here wud be for the child, if taken legal actions how the justice will treat this guy who is innocent and doesnt even know the cause for all this I'm not familiar of how Muslims in India run their social matters , but generally speaking ; and only in my judgment ; khulaa is just another way of divorce . it doesn't matter how the divorce happened . but it is a divorce . so the child in this case has to stay with his mother and the father has to pay an alumni . but if he refused she has the choice either to keep the child without any payments from his father or give the child to father to raise him . |
