Under Adoption Law
Many people do not know Allah. This series (1-69) is an attempt to help them to know their Creator.
Verses 7:145-146 of the Noble Quran talk about: 1) Allah shall turn away believing in His revelations those who behave arrogantly, 2) Allah says: if the arrogates see the right path they do not adopt it and vice versa, 3) Allah wrote for Moses the Law upon the tablets, 4) Allah said to Moses: Take the Torah seriously, 5) What were the Tablets of Torah made from and how many they were? 6) Could Moses lift and carry the Torah of the Quran or the Torah of the Bible? And 7) Allah showed Moses the dwelling places of Pharaoh in the Afterlife

Allah said: O Moses! I have preferred thee above mankind, above the Children of Israel by My messages and by My speaking unto thee. So hold that which I have given thee, act upon that which I have given you, and be among the thankful that I chose to speak to you from among all people.

The meaning of verse 7:145
And Allah inscribed for Moses in the Tablets, that is, the Tablets of the Torah about all things, one needs in religion, as an admonition and a detailing, an explanation, of all things.
In other words, And Allah wrote for Moses, upon the tablets, the lesson, the prohibition to be drawn from all things and the explanation of all things of the lawful and the unlawful, commands and prohibitions. Then Allah said to Moses:
1) Take it then firmly, seriously and earnestly, and enjoin your people to adhere to the fairest precepts in it i.e. command your people (saying): Take the better act and 2) I shall show you the abode of the wicked, evil-livers, the transgressors of Pharaoh and his followers, which is hell; the Eternal Fire.
This indicates that Allah showed Moses the dwelling places of Pharaoh and his followers in the Eternal Fire. These dwelling places are their forever!
Furthermore, It is said that these Tablets were made from the Lote-tree of Paradise, or of chrysolite or emerald, and they were either seven or ten. This seems reasonable because Moses would be able to carry them.
N.B. the Torah today would not be written on 7 or 10 tablets of chrysolite or emerald; one needs some 700-1000 tablets to write it on. These tablets need a big truck to carry them! A world champion of the weight lifting could not carry them!
This is the difference between the Torah mentioned in the Quran and the Torah found in the Bible!
The meaning of verse 7:146
Then Allah said:
I shall turn away from My signs, the proofs of My power, in the way of creations and otherwise, those who behave arrogantly in the earth without right, by humiliating them so that they do not magnify themselves;
and if they see every sign do not believe in it,
and if they see the way, the path, of rectitude, the guidance that has come from Allah, do not adopt it as a way, to follow,
and if they see the way of error, misguidance, adopt it as a way.
That, turning of them away, is because they have denied Our signs and were heedless of them.
A similar statement has been made above.
In other words, Allah said:
I shall turn away believing in My revelations those who magnify themselves wrongfully without any right
it is also said that this means: I will show you, O Muhammad, the abode of evil-doers
it is also said that it refers to who see each token and do not believe, and if they see the way of righteousness the way of Islam and goodness they do not choose it for their way; they would not consider it a way,
and if they see the way of error, the way of disbelief and idolatry they choose it for their way.
Why Allah turns them away? Because they deny His revelations, His Scripture and His Messengers and they are used to disregard them, disbelieving in them.

QARIB: we inscribed for him upon the tablets all kinds of exhortation and clear explanations of all things. so take it forcefully, and order your nation to take what is best of it. i shall show you the home of the wicked.
SHAKIR: and we ordained for him in the tablets admonition of every kind and clear explanation of all things; so take hold of them with firmness and enjoin your people to take hold of what is best thereof; i will show you the abode of the transgressors
PICKTHAL: and we wrote for him, upon the tablets, the lesson to be drawn from all things and the explanation of all things, then (bade him): hold it fast; and command thy people (saying): take the better (course made clear) therein. i shall show thee the abode of evil-livers.
YUSUFALI: and we ordained laws for him in the tablets in all matters, both commanding and explaining all things, (and said): “take and hold these with firmness, and enjoin thy people to hold fast by the best in the precepts: soon shall i show you the homes of the wicked,- (how they lie desolate).”
Verse 7:146
QARIB: from my signs i will turn away the unrightfully, arrogant in the land, so that even if they witness every sign they would not believe it. if they see the path of righteousness, they shall not take it as a path; but if they see the path of error, they shall take it for their path because they belied our signs and were inattentive towards them.
SHAKIR: i will turn away from my communications those who are unjustly proud in the earth; and if they see every sign they will not believe in it; and if they see the way of rectitude they do not take it for a way, and if they see the way of error. they take it for a way; this is because they rejected our communications and were heedless of them
PICKTHAL: i shall turn away from my revelations those who magnify themselves wrongfully in the earth, and if they see each token believe it not, and if they see the way of righteousness choose it nor for (their) way, and if they see the way of error choose if for (their) way. that is because they deny our revelations and are used to disregard them.
YUSUFALI: those who behave arrogantly on the earth in defiance of right – them will i turn away from my signs: even if they see all the signs, they will not believe in them; and if they see the way of right conduct, they will not adopt it as the way; but if they see the way of error, that is the way they will adopt. for they have rejected our signs, and failed to take warning from them.

We cover some essential do’s and don’ts regarding adoption in this article and we hope these will help the thousands of couples looking to adopt a child and build a familly unit. It is necessary to comply with these state outlined adoption rules so as to make the adoption process a legal and successful one, therefore learning about the basics of proper adoption procedures is a big help for prospective parents and they should educate themselves about these to avoid disappointments and debacles later.

They must also carefully go over the adoption contract to ensure they have not missed out on any relevant point or slacking in giving correct and updated information as well as submit and file all necessary documents for speedy processing of the same; if they do not understand some of the legal aspects or details, it is advisable to contact an adoption lawyer or consult an agency to clear these doubts instead of overlooking important issues. Being a long-drawn out procedure, prospective parents must also consider and prepare beforehand their finances for covering the decision to adopt as it can involve many different types of fees.
Prospective parents should understand the various risk factors associated with adoption and work to eliminate these! One of the most typical risk factors involved in adoption includes the birth mother suddenly changing her mind and wanting to raise the child herself; proper screening of the birth mother can help prospective adoptive parents minimize those candidates who exhibit a potential risk of indecisiveness and zero in on those that are likely to go through with the agreement. This precaution can help reduce disappointment at losing out on a child that could have been yours.
Besides the above factor, adoptive parents also need to keep their emotions in check and keep anxiety at bay to avoid making mistakes at crucial points in the adoption procedure as many nervous parents are prone to doing; unnecessary haste and ill-informed parents going in for adoptions make for bad decisions that do not bode well for wanting to build a real family. Understand that adoption process takes time and take this time to read, review and ascertain all aspects of legal documents to ensure an official adoption as well as a lawful one.
Do not be guided by just about anyone when you are looking to adopt a child: go over the legal, social, mental and medical aspects besides the cultural ones of the child as well as academic ones to ensure the right fit for your family environment and your emotional needs; avoid frauds and touts.

If partners are in a same sex relationship, one may decide to adopt a child. In the U.S. the legal requirements of adoption from same sex partners differs from one state to another and also in countries worldwide.
‘Second parent adoption’ is one of the options open to same sex adoption, where a partner is able to adopt the biological child or adopt the partner’s child with the parent still having parental rights. One of the partners, in theory could as a single parent adopt a child. The other partner can also adopt the child, so that they too become the child’s parent. This process is not available in Florida where adoption by homosexuals is forbidden, nor is it possible in Utah, where any couples who are cohabiting and not legally married, are unable to adopt anyone. However, it is possible for single people to adopt in Utah.
In the United States, second parent adoption is allowed for couples of the same sex in California, Connecticut, Illinois, Massachusetts, New Jersey, New York, Pennsylvania, Vermont, Washington and in Washington D.C. The other 38 states that the laws for adoption by partnerships of the same sex are ambiguous. Homosexuality has become a major social issue with civil unions and marriages of same sex couples becoming legal status in many countries. It may only be a matter of time before all these issues regarding same sex partnerships are wiped out.
Adoption by homosexuals is still a relatively new social issue as the jury is still out on public opinion and its’ slowness for acceptance. The subject of homosexuality is still a sensitive and controversial one to touch on, with hotly contested issues and opinions from both sides.
Gay adoption is rejected by the opponents usually on moral grounds as homosexuality is regarded as immmoral. Adoption by same sex couples is seen as highly immoral, as parents are traditionally thought of as being female and the other male. It is thought that heterosexual couples make better parents and that homosexual couples may not be able to fulfill all the requirements of a child. There are several organisations that strongly support homosexual couples – the American Academy and the American Psychological Association of Paediatrics believe that they qualify as parents equally as heterosexual couples.
Many people fear that a child being raised by homosexual parents influence a child greatly into becoming a homosexual, or that the child’s wellbeing could fall detrimentally. Research shows that this is not as preconceived, and that chidren do fare just as well with same-sex parents as they do with heterosexual parents, as sexual orientation has no bearing on the child. A study conducted by the UCLA estimated that by not allowing child adoption by LGBT couples set the United States annual costs which ranged from $87 million and $120 million. This was because researchers found that homosexual couples were more likely to adopt children that didn’t appeal to heterosexual couples. This is includes children that behavioural problems, children that are HIV positive and also older children. Those children that are not adopted are cared for by the State, and this can place a financial burden as they fall under foster care, a system which is draining on government funds.
As same sex adoption is still a controversial issue, progress is still ongoing but moving along. Same sex couples have to look into the laws and regulations where they live and explore all the options to them.

Question: I spoke to someone recently who told me to put my wishes to have a child into the universe and then “let it go”. How does one do this? And, is it not natural to focus on something you want so badly? -Tammy
Answer: When a wise friend says, “Just put it out and let it go” what they are really saying is put into practice the law of attraction and the law of detachment simultaneously.
The law of detachment is essential to intentional creation and it’s primarily about instilling your emotional self with absolute certainty and faith.
The law of detachment is taught throughout the bible for example:
“Then the disciples came to Jesus privately and said, ‘Why could we not cast it out?’ He said to them, ‘Because of your little faith. For truly I tell you, if you have faith the size of a mustard seed, you will say to this mountain, ‘Move from here to there,’ and it will move; and nothing will be impossible for you.” -Matthew 17:19-20
Now, a mustard seed may be small but it is absolutely, positively still a mustard seed. When planted it is not going to produce a cherry tree! Thus, faith as small as a mustard seed contains enough faith to warrant the experience of absolute certainty that when you put it out there, that all is well and Divinely Ordered and in Divine Timing all your desires shall be fulfilled, for the highest and best for all parties involved.
Period!
When you ask, “Isn’t it natural to focus on something you want so badly?” the real question isn’t so much whether or not it’s natural to focus on what we want (because it is), the real question I believe you want to know is, “Why would it be bad to focus on what I want?” The answer is that it’s not ‘bad’ to focus on what we want. However, when we want it “so badly” there’s an undertone of fear and doubt preventing faith and certainty. The doubt is actually creating the ’so badly’ experience of the ‘what if it doesn’t happen for me?’ which of course creates ‘it not happening.’
I enjoy finding support for the law of attraction in the bible, so I have another favorite quote that I remember when I find myself doubting:
“But ask in faith, nothing doubting, for the one who doubts is like a wave of the sea, driven and tossed by the wind; for the doubter, being double-minded and unstable in every way, must not expect to receive anything from the Lord.” James 1:6-8
Substitute the word Universe for Lord and you have the New Thought message that “when you doubt, you get more to doubt about”.
In this example, what you want is to get pregnant, have a wonderful, healthy pregnancy, a comfortable and even magical delivery and a happy, healthy baby.
From time to time, this desire is accompanied by many extenuating circumstances such as the fear and doubts of one or more of the parents. For example, many will have thoughts such as:
What if I’m too old?
What if I’m a terrible parent?
What if something is wrong with the baby?
What if I can’t love this baby?
What if I can’t support a child or my ‘other-half’ and I don’t stay together?
What if there’s something wrong with me (or us) and we weren’t meant to create a family together?
What if there’s something physically wrong with me and I’m defective in some way?
What if it’s too late?
What if I won’t know what to do once I have the child, or what if — there’s so many what if’s.
All of these fears launch creative thoughts into the Universe and are reflected back to us in our experiences. Thus, it can be terribly challenging to hand it over when underneath you feel so afraid (and other negative emotions).
There’s a documented phenomena in medical science known as psychogenic infertility. I often use this example in my seminars because it is documented scientific evidence of the Universal Laws working together.
You’ve heard the stories of couples who want to get pregnant, and they start out trying (you know, the birds-and-the-bees) and nothing happens, nothing happens, nothing happens and six months, a year go by, and they decide to see a fertility specialist.
The fertility doctor orders the tests, they begin In Vitro Fertilization processes and every other current medical solution and still nothing; they just can’t get pregnant. After tens of thousands of dollars and even more tears, the doctor says, “There’s nothing more we can do. Have you ever considered adoption?” and, hands them a parting brochure.
The couple goes home, grieve and eventually decide to adopt. “Maybe adopting is what we were supposed to do? Maybe this is what is meant to be for us? Look at how many children in this world don’t have families and how we are going to be helping one of them. Oh my! I’m so excited about this!”
They take their focus off of having a baby ‘this way’ and put their focus upon, having a baby ‘another way’.
They anxiously wait their turn, adopt a beautiful child, and bring the baby home. And, boom! They get pregnant! “It’s a miracle!” Indeed it is, and it’s also known as, psychogenic infertility and the law of attraction and the law of detachment at work.
So, what do you do about the fears and doubts? First, begin to consciously choose to increase your faith, confidence, certainty, and hope intentionally. Talk yourself into feeling better. Look on the bright side and maintain that, “All is well and in Divine Order at ALL Times!”
Another way to ‘talk yourself into it’ is to deepen your understanding of what faith means. For example, read the following quotes and see if you don’t raise your level of ‘faith’ comprehension:
“Faith is to believe what you do not see; the reward of this faith is to see what you believe.”–St. Augustine
“When you have come to the edge of all light that you know, and are about to drop off into the darkness of the unknown, Faith is knowing one of two things will happen: There will be something solid to stand on or You will be taught to fly” – Patrick Overton
“Faith isn’t faith until it’s all you’re holding on to.” – Unknown
“You block your dream when you allow your fear to grow bigger than your faith.” – Mary Manin Morrissey
Additionally, here are a few other techniques:
EFT (Emotional Freedom Technique), if you have a fear or a doubt – eliminate it now with this powerful meridian therapy. If others can do it, so can you!
Meditation (a good program is the HoloSync program)
Seeking Silence and personal introspection in nature.
Read Power vs. Force and use Dr. Hawkin’s Map of Consciousness to transcend the lower level beliefs.
Call any religious (secular or non secular) organization that offers prayer support. For example, call the Science of Mind (Religious Science) or Unity prayer hotlines and ask for prayers.

It had been three long years for both Karen and David Richards. They had been waiting to bring home a young Romanian girl to adopt. They had kept a photograph of Larissa on the side of their refrigerator only to be told at the last minute by their International Adoption Agency that she had been adopted and placed with a Romanian Family
The Richards’s are one of three families in New Hampshire and more than 100 in the United States that have been stuck in the middle of a complex political situation involving Romania, the European Union and the United States.
During the course of the families’ wait, Romania has continually tightened its policies on international adoptions in an effort to get into the European Union. It now looks as if more families may end up with news like the Richards’s

For another family, the Cohn’s of Milford, the situation was just as bad. “For the first year and a half, we were very anxious,” said Julie Ann Cohn, who filled out her application in 2002 and was matched with a Romanian girl named Katherina in early 2003. “And now for us, it’s more like it’s sad. I feel like we’ve been in limbo for more than three years just hoping and praying, but we just don’t really know what’s going to happen. We’re waiting for a positive outcome.”
The situation in Romania was exacerbated by the fall of Romania’s Communist government in 1989, international attention was focused on the country’s thousands of orphans, many of whom lived in understaffed, state-run orphanages. Romania began offering abandoned children for international adoption in 1990, and many U.S. parents adopted them. But reports of corruption over the years led to a series of temporary bans. Such a moratorium was in place when a family such as the Richards’s applied to adopt.
The International Adoption Agency that took the families’ money and submitted their applications knew that there was a chance the applications wouldn’t go through. But when all of the families received case numbers, names and photographs of the children they would adopt, they assumed that their applications had met the conditions.
The agency based in Windham provides humanitarian aid in Romania and helped the New Hampshire families find children to adopt. The Director said that people familiar with Romanian politics did not take the ban too seriously at the time.
“If the moratorium is absolutely in effect, then Romanian officials would not be assigning children, but they did,” they said. “In many years Romania had rules, laws and regulations, but the sad thing is that in a country that’s recovering from Communism, everyone put their own interpretation into what was law.”
Once families had seen a face and heard a name, it became harder for them to consider that the adoptions might not go through.
In January 2003, Romania enacted a permanent ban on international adoptions, after the EU indicated that such a law would be a requirement for the country’s ascension.
The Romanian Prime Minister said that all of the pipeline cases would be placed with Romanian families, according to the U.S. State Department and Romanian press accounts. But last week, the European Union passed a resolution with an amendment recommending that the country place the pipeline cases with foreign adoptive families.
The outcome isn’t clear. Edgar Vasquez, a spokesman for the U.S. State Department, said it’s difficult to predict what will happen to the adoptive families.
“Of course we hope,” he said. “We’re deeply concerned.”
Julie Ann Cohn said that the recent news from Romania may mean the end of her wait.
“Once we know for sure that it’s a no, absolutely set in stone, then we’ll likely proceed to a different country,” she said. “When I think my heart is ready for it.”
Kathleen Richard said that she was relieved to hear that Larissa had found a loving family, even if it wasn’t her own.
“I’m thankful that she finally has a family, because if she can’t be with us, I wanted her to have a family,” she said. “That’s what I was praying for. For me, it was just like a Christmas gift for her.”

Law and organized social living are integral parts of each other; modern human life is complex one but organized as well. How much modern life is being organized it is becoming more protégé of electronic and digital gear and internet.
Internet is the most advanced electronic communication system. Its role and function are being developed as inevitable part of life of man of this age. The legal developments in the history of internet are in initial stage we may trace the footsteps of legal development which has opted nationally and internationally.
UNCITRAL was established by UN in 1966 and it is stand for United Nation Commission on international Trade Law. Its basic purposes among various others to promote and adoption of new international conventions, model laws (a model law is a legislative text that is recommended to states for enactment as part of their national law) and uniform laws for international trade laws. The models laws which have been adopted by UNCITRAL in relating to the electronic commerce and electronic signatures were as underneath;
1. Model law on Electronic Commerce 1996.
2. Model law on Electronic Signature 1998- 2001.
These model laws played a fundamental role for preliminary enactment of electronic laws in various countries.
Wipo Copy Right Rules 1996 and Wipo Performance and Phonograms Treaty Rules 1996 are regulating the copy right infringements and trade mark issues at nationally and internationally. The ICANN Uniform Domain Name Disputes Resolution Policy 1998 a non-profit corporation that was created to supervise a number of Internet-related.
The Digital Millennium Copyright Act 1998 (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works and it also criminalizes the act of dodging an access control, whether or not there is actual infringement of copyright itself.
The European Union passed the EU Copyright Directive or EUCD 2001, which addresses several of the issues as to criminalize production and broadcasting of technology, devices, or services intended to circumvent measures that control access to copyright.
The Information Technology Act was enacted in the year 2000 with a view to give an impetus to the growth of electronic based transactions, to provide legal recognition for e-commerce and e-transactions, to facilitate e-governance, to prevent computer based crimes and ensure security practices and procedures in the context of widest possible use of information technology worldwide.
The Electronic Transaction Ordinance 2002 and Prevention of Electronic Crime Ordinance 2008 were enacted in Pakistan to provide legal recognition for e-commerce and e-transaction and to prevent computer based crimes in the contemporary digital age.
Evolution of legal process always run side by side the society move, problems and issues are always interrelated to all kinds of facilities that man adopts. The electronic age required to be recognized its uniform legal existence to resolve its issues coming forth. Model Laws and rules adopted by UNCITRAL are basis of all electronic laws and rules enacted and introduced at nations. World recognized uniform laws, rules and policies can only resolve the all electronic issues successfully.

In the world of International Adoption, Guatemala is one of the most popular and least regulated Countries. Last year there were estimated to have been 1,500 Guatemalan Children and Babies who have started fresh lives abroad, but the spectre of Illegal Adoptions have haunted Guatemala for years. Stories have emerged of mothers being forced to give up their new born children and of a booming private adoption business that has now grown almost into a multi million pound industry.
One of the key questions to look into is, are illegal adoptions taking place and if so how widespread is the practice? Finally, what is in the best interests of the Children of Guatemala?
“With Overseas adoption, what is in the best interests of the children of Guatemala?”
Whilst organisations, such as UNICEF, do not claim that all of the overseas adoptions coming out of Guatemala are illegal or abusive, a new report issued from the organisation does highlight the increasing problem of child trafficking.
“Overseas adoption arose directly out of Guatemala’s harrowing history.”
Overseas Adoptions and International adoption arose directly out of Guatemala’s harrowing history. The 36 year civil war which ended officially only four years ago left nearly a quarter of a million dead or disappeared and one million homeless, half of them children.
Elizabeth Gibbons is the director of UNICEF, and a leading critic of adoption as practised in Guatemala:
‘Many, many orphaned children were taken into adoption by military officers sent into international adoption. Originally a humanitarian activity, but it became obvious that it had the potential for being a lucrative business. And the higher demand in the West the more birth control, more access to abortion so you have the problem of a huge demand, therefore a supply must be created.’
In recent years there has been a tightening up of controls in many of the major embassies and the UK, US and Canadian embassies now carry out DNA tests of both the birth mother and the baby to check out that the woman giving the baby up for adoption is the real birth mother.
‘The existence of DNA doesn’t in any way tell you whether the mother is willingly giving up the child or whether she is being coerced. The second concern is that the children who pass the DNA test are not the same ones who go with the adopting parents on the plane, they could be switched. And thirdly, that the child who is rejected for having a negative DNA result by one of three embassies that offer this test, can then be offered to another embassy with parents of a another nationality.’
‘No one respects the law or the state; everybody just does their own thing. And it’s the same with adoptions’
So with all of this abuse of the system going on, why hasn’t the government of Guatemala done anything to stop it. The general consensus is that Guatemala is in chaos with the country, now a fledgling democracy, only just emerging from under the shadows of years of Military rule
Guatemala is a difficult place from which to operate from and it is very hard to know who is in charge of what. There doesn’t appear to be a Minister in charge of Social Affairs and Adoption is very much bottom rung on the ladder.
The Chair of the Commission on the Child and the Family in the Guatemalan Parliament is Nineth Montenegro who is a vigorous critic of her own system and is campaigning to pass the “The Children’s Code” to protect the rights of the Child in Guatemala explains:
‘We’ve been working on it for three years now and parliament still hasn’t passed it. They say, if we try to regulate adoption in this way we will deny children better opportunities in wealthier countries. There has been terrible resistance to the new law. You know Guatemala is a democracy only in name, not a real democracy.
No one respects the law or the state; everybody just does their own thing. And it’s the same with adoptions.’
