I am going to be adopting a baby and the birth mother wants us to take it home from the hospital. Does anyone know what procedures need to be done to insure it is done legally? We do not have an agency involved in the process. You must either have an attorney or an agency to proceed with an adoption legally. There are certain state laws that you will need to abide by or the adoption will not be considered legal. If you are taking the child to another state, there is an Interstate Compact that needs to be filed and approved before the child is allowed to leave the state. contact a family law attorney. They can help you. That's illegal and you HAVE to get a Child Placing Agency involved! Unless you want to risk the birth mother changing her mind a few months later and having you arrested for kidnapping, you probably need to involve an attorney or an agency. Contact a lawyer and get a form written up that you and her sign, and then when the baby is born you and your significant other will be on the birth Certificate and the baby will be yours. Well, you don't need an agency, but you do however need a lawyer.There are many different ways to go about it. You can have the mother sign temporary custody order That's what I'd recommend so there's no question about it.. That will give you permission to take the baby home from the hospital. Don't listen to the people that say you Have to have an agency or it's illegal, It's NOT. Many people don't know everything about adoption. I know because I was adopted from newborn, and my parents are also trying to adopt a baby again, both without an agency.
