Can you make an adoption legal with a notary public?

I want to adopt my sister's baby and we are trying to find the cheapest way to do it, would it be legal if we all agree to go to a notary public? Would it stand up in court if she changed her mind?

No the best you can do with a Notary is to get a Power of Attorney, which would give you certain rights, however this can be recinded as simply as it was made. to assure your legal rights you need to see a lawyer and have a formal adoption. If you qualify this may be done through legal aid or someother type of reduced charges. You will also need the fathers permission to do the adoption and in these cases they will usually sign away their rights rather than have to pay child support. With a Power of Attorney the court could order both parents to pay child support, so if they are wanting out of the responsibilities they will probably want a legal adoption.

There is more involved than what a notary public can do. You really need to see a lawyer.

a notary can witness you sign the papers that the court gives you to sign.

but you will have to have a judge rule on it. And as far as changing her mind, each state has allowances for people changing thier minds and some ahve certain time frames.

You will need to get an attorney have them write up court papers. there will be acourt hearing ( maybe several) there will be home inspections and so on.

I'm a Notary in California and the answer in this State is a definate NO.

No you can not do it thru a Notary. You must do it thru an attorney or an agency.
