How long do I have to appeal the adoption of my child?


to make a long story a little bit shorter
she was taken from me by cps, for environmental concerns,
I wanted to appeal her being adopted but didn't because
she was being adopted by my mother in law
and I kept hearing over and over again that once
she was adopted that I would be able to see her anyways,
and that i had no chance of winning so there was no reason to appeal.
I even signed a statement saying because my mother in law is going
to let me see her after the adoption that I didn't want to appeal the case.
That is the ONLY reason i didnt appeal it, its been at least 2 and a half weeks since she was adopted and my mother in law will not let
me see her.
What can I do ?
if anything?
I really miss my daughter and want/need to be in her life
I am in the state of pennsylvania if it helps.

You were told wrong...even the most foul of mothers (NOT saying you are...just providing that as an example) has a right to appeal the adoption.

If your rights aren't terminated yet, consult an attorney right away.

everyone always thinks about themselves. your baby has only been there for two weeks let her have time to adjust. even if she is only a few months old they need a chance to adjust. my sister is in this same potion with her daughter and it makes me so mad because she thinks of her needs and her feelings and not her babies otherwise this would have never happened in the first place.

wow hun, sounds like there is nothing you can do. you might call a local family lawyer and ask them if there is anything you can do, but i seriously doubt it.

I believe you have 3-6 months to appeal. Have a friend going through the process. Its been in court for awhile its along process. I wish you the best of luck. Also in PA. Feel free to e- mail me for more details.

if you didn't voluntary give her up, i don't think there is much you can do. But the time frame to appeal an adoption case is 30 days. they just changed it from 90 days last year. My best friend was appealing the adoption of her daughter just after the law was changed. Her case was the first in the state of pa to be tried under this new law. But hers was a voluntary adoption. Frankie is right it is a very long process. our friend has been in court for almost two years with little results.

It is possible that your MIL wants the child to get "settled in" a bit more before seeing you.

Contact CPS and ask them why you are not being allowed to see the child.

"Environmental concerns" covers a large area. It generally means that the environment you were raising your daughter in was unsafe. CPS gives a parent lots of opportunities to correct things. Stop using drugs, take parenting classes, kick out that pedophile you are living with, etc. Whatever they deem the problems to be.

It generally takes a year before they terminate parental rights. That is done ultimately when it is evident that the parent is not following the plan.

They cannot allow the child to be adopted until parental rights have been terminated. What I am saying is you have no rights.

You chose to not follow the plan that would reunite you through CPS. You chose to not appeal. Your appeal would likely NOT have been successful anyway.

You had ample opportunity to demonstrate that you loved your daughter and wanted to be in her life. You didn't do that.

While what I am saying sounds mean, I am a child advocate. She deserves a chance, you already had yours.
