Can an employer deduct from FMLA eligible time without the employee requesting FMLA? |
If an employee needs to take time off for an eligible FMLA reason (adoption, illness, ect.) can the employer automatically deduct from the individuals 12 weeks for the time taken? Even if the employee does not request FMLA? NO. The employee needs to request the time off be FMLA. Although some employeers may think so. |
