Are sex offenders allowed to keep any children they have?


My children's birth mom is on the sex offender registry, and we adopted her 2 children (closed adoption through the state).

She has since had another baby, but the baby is still living with her...I thought a sex offender wasn't allowed to have children, being they can't be around children?

Can anyone shed the light for me?

I cannot divulge the whole situation, but she has 2 criminal offenses, both involving minors (the last offense, that got the children removed the second time, was with her own daughter, my daughter...she didn't molest her or anything, but it was a choice in poor taste to do what she did).

There is not enough information here. To begin with, there are different levels of sex offenders. The courts have rules about what contact with children she is allowed. Most states do allow parents to keep custody of their own children unless it is obviously endangering the child.

Also, just because she was convicted of a sex crime does not mean she is an unfit mother right now. I am sure she is trying to correct her life and that this child might help her find some normality.

Nobody has the right to take a child from a home because of past crimes. They can take them due to the ruling in the original case when the sentencing is delivered; however, taking a child now is a violation of her rights unless they have reason to believe she committed another crime.

Also, many people on the sex offender's list didn't commit crimes against children, but many times against other adults (or a few years difference with a minor that branded them on the list)

Zachary's law needs to be updated to have a child sex offender, a violent sex offender, and removal of a 21 and 17 year old from the law. Too many people seem to have the same impression you do, and it's not fair to the immature kid who got lucky with his or her partner at the time.

It should also be noted that things such as taking a piss behind a dumpster, in no way dangerous to anyone at all, are still technically sex offenses. Pedos and rapists are dangers to children. No other sex offender is.

Yes they can have children and have custody of their own children..unless a court refuses them to do so.
In some states the victim of incest is returned to the offenders home.

Sex Offenders from what I know are not allowed to have custody of children in some states if a child even lives in there home they can be sent back to prison.

I don't know, but they shouldn't be allowed to keep kids, in my opinion.
