Relinquish parental rights - read question for details?


The child in question is 2 mo old, paternity hasn't been legally established because the father is 1 of 2 men - therefore there is no court order for child support. The mother is going to get supenoas for the 2 men in question for DNA tests. Both men are aware of this and want to relinquish their parental rights (if they turn out to be the father). I know to relinquish your parental rights you have to go thru the court system & go before a judge. But can a man relinquish his rights soley because he wants to? Because he wants nothing to do w/the child EVER? Will that uphold in court? The mother doesn't care if he decides to do that. She is just wondering if it's possbile.
Keep in mind, both men are willing to pay child support once paternity is determined and the amount is set. But will they still have to pay after their rights are relinquished?
The child is not up for adoption by any one else.

Neither of the men want any part of the child's life and haven't even seen the child.

If the mother collects welfare for the child and there is no other man willing to take over the support of the child then the biological father will have to pay wheather he sees the child or not.

I'm not sure what you are asking here..... if the man doesn't want to see the child then he doesn't have to... no relinquishing needed.

Or are you really asking if you can ensure that the father doesn't have any rights later on after the child is born.... basically not giving him the option of changing his mind.

A judge cannot make a decision that will leave a child fatherless. If no one steps up to adopt the child the paternal father cannot relinquish his rights (legally). In the real world, the mother can choose not to seek child support and the father can choose not to seek visitation or joint custody. There- rights relinquished. We don't need no stinkin' judge.

This can be done in the UK (mentioned country as not sure where you are from) but only if it will be in the best interests of the child which would have to be established by one or both parties

If the DNA testing/paternity determination is being doone because the spouse is going on welfare, the courts will not permit the bio father to terminate his rights.

Bottom line - being a biological father doesn't mean you have to have anything to do with the child, other than provide financial support. At some point, the baby's mother may ask the bio dad to terminate parental rights so that another man can adopt the baby - but you can't terminate your rights just to keep from paying child support.
