Grandparen'ts Rights Law...Somebody Please Help!!!?


My mom is threatening to take me to court for visting of my daughter ( her granddaughter ), b/c I don't want her in my life or my child. She's a psycho to sum it up, she's married to an alcoholic and she didn't take care of her own kids. Now I googled the grandparents rights laws in my state, and here's what it said:

North Carolina The custody statute does not provide statutory factors for determining the best interest of the child. A court may grant visitation rights as part of an order determining custody of the child. Adoption cuts off the visitation rights of grandparents unless adoption is granted to a stepparent or a relative of the child, where the grandparent proves that a substantial relationship exists between the grandparent and grandchild.

Can someone please explain to me what this means. I'm not a stupid person so please don't think that, I just don't understand all of this crap. I also really don't want to go to court and fight over this with her.

She could go to court and ask a judge for rights to visit your kids. If you want to prevent that, or fight it if she makes such a request, you need to document why she should not see your kids.

Get notarized statements from your siblings about her and her husband. Same from her neighbors. If she has a police record, try to get that. Find a lawyer who can help, if you do wind up in court. Do you want to go all the way to a restraining order against her?

Track and record her contacts with you, and why they disturb you. The longer the record against her, the more likely a judge will listen to you.

Every country and state has different laws, so you need to get some legal advice in plain english from child welfare.
Consider a retraining order if she is threatening you / which then may solve the problem of stopping your mother from any access.I live in Australia so laws will be different where you live. Ask welfare people they know the law in your area and can advise you the best options.

You have to prove your mother is a bad for your child. If it is the truth you can find things to prove your case. witness, any police reports, dig up the dirt you need proof for the courts to believe you. Then just sit back and wait for the day she tries to mess with you . You have to stay balanced at all times, this is very important , and remember you need to be the best parent you can be. It looks like the only way she'd get visitation rights was if she had a court order.
