What are the father's rights now? Will another state hold another's court ruling??? |
I am moving out of state to be with family. There are no jobs in my area and the economy (much like everywhere else) sucks. I thought at least with family around, that could cuts costs of living and the day care bill. However, the problem that I have is that my daughter's birth father lives in the state that we are moving to. We are moving from Michigan to Missouri. He gave up his rights legally to her, and my now husband has adopted her. The adoption took place almost 6 years ago. Generally speaking where the legal father resides (your Husband) is recognized as her father whereas the birth father has relinquished his rights prior to the adoption. Legally, your husband is the father. The biological father is considered a stranger. He has the same rights where your child is concerned as I do. Where the termination and adoption took place is irrelevant. |
