Social Security survivor benefits.? |
I live in Texas and I adopted my son in Feb of this year. His biological father terminated his rights and agreed to the adoption. The biological father passed away last month. My question is will my son be eligible for the biological father's social security benefits due to him terminating his rights and my son being adopted? I doubt it. The child has been legally adopted so the the biological father had no further obligation for the support of that child. Survivors benefits are given when a parent passes away for the child's support. Since the child no longer relied on that parent for support,he wouldn't get the benefits. He terminated his rights before passing,so he was legally no longer his father. I live in Louisiana and I have a few blind friends who have children who have seen an attorney to make sure their child would receive benefits if anything happened to them. I am not an attorney so I am not sure if the answer is yes or no. Since it would give the child a check every month and help with the cost of finishing his education and trade school or a University, I would consult your lawyer. I would go to court over it. You adopted the child as the father was ill and dying and if the SS benefits were not signed away, it should go OK! |
