If my daughter was put up for adoption without my knowledge, and my name isnt on the birth cert what can i do? this is an every day occurrence - so what to do? you are not on the birth certificate as the father, yet you can contact the agency handling the adoption and insist on being the father. depending on your financial situation, obtain counsel and seek a temporary injunction to prevent the adoption from going through. First of all, you name has to be on the birth certificate. Also, you need to hire a lawyer and fast. Was this a kidnapping? I am not fully understanding your situation. If your name as the mother is not on the bc you are outta luck dear....and why would that happen anyway? ... if you gave birth to her?????? I agree, your name should have been put on the birth certificate. Even though I don't understand the entirety of the situation, I would recommend that you seek legal advice and possibly pursue DNA testing to prove that your daughter is actually yours that way you might be able to stop the adoption. Hope this helps. you have to take it to court and do DNA testing, then contest the motion 1. Get alawyer Have you ever considered that the person asking this question is a man? I would first get a lawyer like the first person stated. Secondly, I would establish paternity. That may require a DNA test. Thirdly, notify whatever adoption agency is involved that you have an interest here...this may halt the proceedings for awhile so that you can get your lawyer and filings in order. If a child is put up for adoption without the parent's consent, this is kidnapping. You should call the FBI immediately (unless you are not telling the truth.) I take it, you THINK you're the "lucky" father. If that's the case, the problem is you made a child and DIDN'T FOLLOW UP on the mother. Get a lawyer. If you can't afford one there is legal aid to persons who can't afford a private lawyer. I'm assuming that you are the dad. I would think that you would have a good chance at getting your daughter as long as you don't have anything in your past that would deem you as unfit. The amount of time that your daughter has been with her new parents will determine how much taking her will effect her, but I'm sure in the long haul she will be glad to know that you fought for her.
