Divorce, legal costudy, adoption?


Okay so鈥?I'm fifteen, and residing in the state of Virginia. My parents are getting divorced and moving their separate ways. I really really really do not want to end up with either of them though, for respective reasons. Would it be legally possible to transfer legal guardianship or custody to a family friend? And would this require parental consent? And if it did, could the parents originally awarded custody consent to this?

Yes, you could be adopted by someone if your parents gave consent, but the likelihood of them doing so is likely low. Perhaps you should get family counseling. You can't be adopted without consent. You could also apply to be an emancipated minor, which would require that you be able to support yourself and be mature enough. My guess is that you would have a hard time proving that.

it sounds like you need some legal counsel, not something i would rely on getting here @ y!answers. at fifteen, i would think that you should have the maturity and knowledge to make decisions that affect your life. i have heard of instances where people have transferred legal gaurdianship, but all of these pertained to abusive situations or death. if you are in an abusive situation, seek help from a trusted adult or law enforcement officer.

the biggest issue is that you are safe and well cared for. i hope everything works out for you in this situation.

It would require the consent & cooperation of both parents & if there is an existing court custody order, the court too.
