Step parent adoption...?


OK. My husband filed for a step parent adoption last month, we have a hearing set up for next month. Today his lawyer called and said my ex had contacted her and was going to fight the case. (We did not expect this as he has not seen the kids for over 2 years, has not talked to them for 2 years, and has not sent a letter, email- nothing for 2 years. He is also $5000+* behind in child support!)
Anyway she gave my husband his number and he called him, and he said he was going to move to our state and his wages can be garnished- whatever.
Does his bad behavior in the past serve against him? Or will his just showing up erase all of his lack of support and visits?

*Last payments were January of 2006, and June of 2007. Very small amounts. (As you can see 17 months apart in payment!)

While the biological father wants to be a part, I think that this past behavior WILL play a part.

What is best for the child? I think THAT is what should be on everyone's minds. Personally stability is what I think would be most important, not going 2 years without seeing your child.

These are questions your lawyer can answer better than we can. And the state you are in will make a difference.

No matter what, a parent always has a chance. Lawyers are very good at doing their jobs, all he needs is a good lawyer, but usally the mother has priority over the kids.

It will make his credibility go down. Most judges don't tolerate dead beat parents.
