Family Law Help! Please!?


My Partner was involved with a woman about 3 years ago. At that time, she informed him that she was pregnant and it was his. They visited counselling, and had decided on adoption. They met with the adoption agency, but a month before she gave birth, she decided that she wanted to keep the child, she also revealed that she lied about being on birth control. After the birth, a social worker contacted him, and he requested a paternity test. He (my partner) tried to set up appts. to have the test, but the mother always refused the dates, after a few months of trying, he gave her the phone number and requested she book the date. After that, he never heard from her again. It is now two years later, and he has been summoned to court for child support. I know his first step is to have a paternity test, but what are his rights and responsibilities if he is the father? What are the next steps before the court date? He does not want to be a part of the childs life unfortunately. We are in Canada.

She sounds like a head case...but that's not the child's fault. And neither is it the child's fault that these two people created him or her.

Common sense says, they had sex...they knew the responsibilities that came along with that and now they are paying. He's actually lucky that's he's not had to pay for the last two years.

I hope he reconsiders his position about visitation if the child turns out to be his. It's not the baby's fault and it shouldn't be punished.

I'm in America. If he's the daddy, his rights would be reasonable and liberal visitation. The mother will probably have sole legal and physical custody unless he wants more time with the child which it sounds like not. His responsibility by law is to pay the child support and reasonable other fees such as paying for medical and dental insurance. He should get an attorney before the court date. He may be ordered to pay for an arrearage since he has not paid any support to date.
