A woman who became pregnant after a one-night stand yesterday won the right to keep the existence of her baby a secret from its father.

In a landmark decision, three Appeal Court judges agreed that the 20-year-old single mother has "the ultimate veto" over whom should be told about the child, who is being put up for adoption.

And Lady Justice Arden said this was not a violation of the father's rights to family life under the Human Rights Act because he had no rights to be violated.

When she asked for the child to be put up for adoption, a county court ordered that her parents and the father should be told to give them the opportunity to apply to adopt.
But yesterday, the judges decided the father had no rights over the child, who is now in foster care, because "he was only a one-night stand". And they banned the local authority and guardian from taking any steps to identify him or telling him about his daughter.

The judges heard that the pregnancy resulted from a "one-night stand" with a colleague while both were "on the rebound having broken up with long-term partners".
"He is now back with his fiancee, continuing with that relationship and he has no idea she has given birth to his or any other child." She said the young mother was "absolutely clear" that she did not want anyone to know who the father was.


So do you think the father should have been told about the baby or not?

As far as I'm concerned, any man who does not make a consistent commitment to stay and take care of a child has no business complaining if he's kept out of the loop. If he wants a say, he needs to take explicit responsibility.

But that's a personal opinion; it sounds like you're looking for a legal analysis, which you need someone better trained for.

I think he should have been told about the baby because even though it was a one night stand the child is still his flesh and blood. If he wanted to keep the baby, he should have had the right to do so.

Yes I do. Genealogists are really going to have a tough job in another hundred years. Nobody knows who their dad is anymore. Yikes!

think of it this way what if you were the kid would want to at least know who or meet your father. good or bad you would have the option and so would the father.

YES! This is crazy! It may have been a one night stand but it was a mutual one nighter. It only takes one night to get pregnant, this should have nothing to do with it. It wasnt that he ran off and never contacted her. I dont care what these idiot judges say, they are violating this father's rights under the Family Rights Act. He should be given the right to decide. This is not right, what about the child's rights???? No one is thinking about that! The child has a right to know who her father is. She will be searching in about 15yrs, I bet.

I think he should have been told because, even though it was a one-night stand, the baby is still his daughter. To add to that, if the baby was put up for adoption he should have been told, so he could have a chance to keep her instead of her going into foster care.

What state is this in? Or is this even in the US? In Illinois, this wouldn't fly due to the fallout from the Baby Richard Case. I have had an adoption case before where the mother refused to say who the father was. While we were never able to get her into court (because the Mother was not wanting to make the effort to show up in court to consent to the adoption), we still had to do notice by publication at the last know address of the father . The general public policy is that a child has a right to have a relationship with his/her parents. If the mother already gave birth, and is putting the child up for adoption, why shouldn't the father have the opportunity to have custody of the minor child? Many times the father might not object, but there are documented cases where they do object. This would be different if the issue was whether the mother should be forced to give birth instead of have an abortion.

NO..with a one night stand and the guy reuniting with a different woman that is now his fiance why possibly ruin things with that? I feel that the adoptive parents should be given the chance to give that child a home with two parents that love each other and the child, not to disrupt many lives and let a child know that their birth mother gave them up after the natural dad and her conceived them just b/c they were on a rebound from broken relationships. That isn't fair to that child. Let the child grow up in a home where it is welcome and wanted. Not where it was an "accident" from one night of sex.
