My daughter's bilogical father....? |
Has never met her and chooses not to be a parent in her life. She is 4 years old now and I obviously have full custody of her. BTW, his name is not on the birth certificate. Hmm, technically if his name is not recorded anywhere on anything legal, you could claim you don't know who her father is. I doubt that you would have any problems with the adoption. He only has claim to the child if he has been asked or told about the adoption proceedings and doesn't reuse to allow it. If he does step forward and argue the custody then their maybe a dilemma. It is less likely he could succeed if he was informed and never stepped forward but if he never knew then he will still have all his rights. If his name appears on her birth certificate, then unfortunately yes he does. I adopted my than wife's child when she was 4years old. She, in our state, had to get permission from my beautiful daughters bio dad to adopt. Like your situation, he wanted nothing to do with his daughter and gave up all parental etc etc rights to her(his loss,asshole!!). She is now 27 and a loving, caring daughter of mine. What a blessing, I hope your fiance has as much joy. You will have to publish his name in various papers. If he doesn't respond in x amount of days you can go through with the adoption. But legally you have to give the losers ( which I think is crap) time in which to contest the adoption. Good Luck!!! |
