My daughter's bilogical father....?

Has never met her and chooses not to be a parent in her life. She is 4 years old now and I obviously have full custody of her.
Does he still have parental rights?
My fiance has been in her life since she was 8 months old. he would like to adopt her, does her biological father who doesn't pay child support, denies her, never met her, have say in her adoption process?

BTW, his name is not on the birth certificate.
And I have not filed for child support for my own reasons and choose not to.

Hmm, technically if his name is not recorded anywhere on anything legal, you could claim you don't know who her father is.

The court would publish a notice of the intent of adoption in the local papers for a few weeks, and if the father doesn't appear to object, then all goes through without a problem.

If you had acknowledged anywhere that he was her father, you would still have to notify him and get his approval, but I would just play dumb and say you don't know who her father is.

Unfortunately even if the father doesn't visit the child, pay child support, etc. he still has rights in the eyes of the law. Stupidest thing I have ever heard of, but oh well...

I doubt that you would have any problems with the adoption.

Since the "father" doesnt want to have anything to do with her and denies her, then he has no interest in her whatsoever. And, if he WAS to try to stop it...then sue him for all the back support that he hasnt paid a dime for!!

That will send him on the same tune of not caring one way or another...

He only has claim to the child if he has been asked or told about the adoption proceedings and doesn't reuse to allow it. If he does step forward and argue the custody then their maybe a dilemma. It is less likely he could succeed if he was informed and never stepped forward but if he never knew then he will still have all his rights.

If his name appears on her birth certificate, then unfortunately yes he does.

Your lawyer will have to get him to sign a paper relinquishing his parental rights, which shouldn't be a problem if he really doesn't want anything to do with her. If he refuses to sign them, then just take him to court for child support. That ought to straighten his will to sign right up.

I adopted my than wife's child when she was 4years old. She, in our state, had to get permission from my beautiful daughters bio dad to adopt. Like your situation, he wanted nothing to do with his daughter and gave up all parental etc etc rights to her(his loss,asshole!!). She is now 27 and a loving, caring daughter of mine. What a blessing, I hope your fiance has as much joy.

You will have to publish his name in various papers. If he doesn't respond in x amount of days you can go through with the adoption. But legally you have to give the losers ( which I think is crap) time in which to contest the adoption. Good Luck!!!
