Is it legal to have an abortion at 8 months?


I would like to know if in the U.S. is it legal to have an abortion at 8 months when the child nor the mother are at risk?

I'm a male so no, I am not considering abortion so don't give me any crap about how it's wrong and adoption etc., etc.

I only want to know about the legality of the issue.

I don't need to know your personal morals on the subject ok?

8 months, hell yes it illegal....If you that stupid you shouldn't even be having sex.....

It is illegal in most States but in a couple it is legal. There is however supposed to be serious health risk to the mother.

It depends. Roe v. Wade it simply stated that abortion is legal by the U.S. Constitution but that abortion laws may be restricted by the states to varying degrees.

Most states require some reasoning involving danger to life and health of the mother for late-term abortions.

The Partial Birth Abortion Act (a federal law, thus applying to the entire United States), bans a certain form of late-term abortion. Specifically, it bans the "intact dilation and extraction" or "D&X" procedure, by which the fetus is partially delivered and then (and here's where it becomes politically loaded) killed/aborted. The law, however, contains an exception for the life of the mother (but not, as previous Supreme Court opinions had mandated, for her health).

The Act does not ban "dilation and extraction" or "D&E" procedures, whereby the fetus is separated into pieces within the womb and removed piece by piece. One might think, "Why is it better to tear it out piece by piece rather than whole?" Good question. But you don't want me to go into that, so I won't.

Finally, the PBAA was upheld by the Supreme Court in 2007, in Gonzalez v. Carhart.

First of all, technically, miscarriages and stillborns are text identified as involuntary abortions. So those would be legal, because they are involuntary. Someone who is 8 mon. pregnant can't simply walk into the dr. and say they want an abortion. Even if it were legal, a doctor would never do this unless the mother was at risk or dying. And there is more of a chance of the mother dying by forcing the abortion than just letting her have the baby at the 8 month point. Plus they would know way before 8 months if the mother were at a serious risk.

PS- if you are a man, this is a stupid question.

The legal aspects are usually categorized by trimester. You are talking about a third trimester situation which generally requires serious special circumstances. Short answer: No. The others here have posted good responses.

At that point its called murder. some babies are born prematurely at 8 months and live healthy lives.

Babies born at 8 months are almost healthy and viable like many people i know that were born at 7 months, one is actually a doctor- they can live a healthy lifestyle. No woman in any country in this world can carry out such a procedure legally. If a baby is aborted (killed) at this stage it can be life threatening for the mother with the minimal of chances of survival - it is actualy considered sick in this day and age. So to even think about it would result in one being very sick - no offence but help is needed here!
