What chance has my 16yr old son of getting custody of his unborn baby when its born?


My sons gf is putting the baby up for adoption with a claus my so is not to to get custody.If we go through the proper channels with our legal team when the baby is born what are the chances of him getting custody? There are no reasons what so ever this claus has been added its just out of spite.

The girlfriend has no legal rights to terminate the parental rights of your son, and adoption terminates parental rights. There is no clause in any contract that can speak for another person regarding this. You need to get an attorney before the baby is born so that he/she can file a motion staying the adoption if necessary.

If your son wants custody of his child and she wants to relinquish her rights as a parent, there is nothing she can do about it unless there is a law in your state. I've never heard of such.

I would say your chances are good. A lot depends on what state you're in. However, most states prefer a biological parent caring for their own child.

I don't think the gf can do that. I believe that the state will give custody to one of the parents before allowing an adoption.

How well prepared is your son to raise a baby? That is, are fully prepared to raise this child yourself? Any 16 year old single parent is going to need alot of assistance and support to not only raise the child, but so that your son can finish his education and be able to provide a decent life for the child.
I'm all for adoption, as the gracious people that are approved for adoption are well grounded, financially stable, loving adults.

What legal team?
If they were any good, they would have already filed the necessary legal papers to prevent her from giving up the baby for adoption while at the same time they would be filing for custody on behalf of your son.
Sounds ilke your 'legal team' is not up to snuff!

Pretty darn good if he's not a horrid criminal. She cannot, legally speaking, opt to terminate his rights. She is certainly free to sign over her own if she wishes when the child is born.

Get your legal team assembled NOW, before the birth, if you want to do this. You need a court action filed before the baby is born - even if it's not final, the fact that it is pending will prevent anyone else from being able to get the baby.

The laws vary from state to state, but most courts always prefer to keep the child with the bio family in such situations, as long as the bio family is not unfit.

Just be prepared to raise your grandchild as your own though, because 16 is way too young, no matter how mature and ready they think they are.

if she keeps that baby your son will be forced to pay for it or go to jail. a woman in this country can kill his baby without his consent or knowledge.even give it away never telling him or giving him the chance to raise his own son. this is an outrage. he has no chance .i so hate this right to chose. i intend to see it taken away.

The court will look at what is best for the child.

16 year old daddy would need to prove that he can provide proper care for the child while he is at high school and at work. He would need to show that he could be financially responsible and pay the bills for child. The judge will be concerned as to what kind of job a high schooler could get that would allow him to support a family. The judge will also be concerned that the baby is just dumped on the 16 year old's parents to raise while the 16 year old goes on with the life of a young person. Right now Grandparent's rights, or lack or rights is a hot issue. The 16 year old's plans for college, work, and his future will also be scrutinized.

That clause was not added out of spite, it was added to give this baby an opportunity of being adopted by two ADULTS who can financially care for this baby in the best possible way. Your 16 year old son should be happy the girl's parents did not have him arrested for sex with a minor.

In the US, your son would get custody of a baby up for adoption, because a child cannot be BUFA without the consent of both natural parents.
I am not sure how the law works in the UK, but assuming there is no compelling reason that your son should not have custody, I think he has a very good chance.
It is very unfortunate how the law always favors the mother, and even allows the mother to have an abortion without the father's consent. That isn't fair.

Good luck! You should make the agency aware that the father is in the picture and he does not agree to the baby's adoption. Perhaps talking to her parents and asking for cooperation
