How do you file a lawsuit against a agency for breach of contract without using an attorney? |
I had a contract with an adoption agency , in the contract it states that the $250 application fee is non refundable, i understand that. It does not state anything else about any other money and we sent in a couple installments and have decided not to go with this agency (whom by the way has not doen anything for us yet ) they claim that even though it doesn't state it in the contract that they keep all of the money and if we ever decide to adopt from them even 10 years from now our money will be there. i don't agree with that and since the contract does nto state that the money is non refundable they should have to return it. you might want to see if you can get a free counseltation first to see if you are correct in this matter before you waste any time. Sometimes you can find a lawyer who will do it pro bono. You just gotta look. Good Luck. beats me It depends upon the language in the contract. If they weren't doing anything for you why were you sending them additional money? Sue them in small claims court. It's not expensive. Just make sure the monetary amount is under the jurisdictional limit. sound like a case for judge Judy. if it states that only the application fee is non refundable and you are not happy with them not doing anything for you then yes you have a law suite. you payed money for services rendered. if nothing was rendered you should be able to recoup anything payed other then your app fee. if the amount paid is less then $5000 then small claims would be the way to go. good luck I agree with JB on suing them in small claims court. The jurisdictional limits vary from jurisdiction to jurisdiction, so be sure to check. You can also find out which agency in your state regulates them, and threaten to complain to that agency, or to the state attorney general for fraud. A lot of times tihs is a more effective threat than a lawsuit, since the regulating agency or AG can put them out of business. It depends on the amount of money involved. Go to you local Small claims court. They will assist with filing out a law suit. |
