Hypothetically - if one parent is in prison, can the sole custodial parent change the child's legal last name? |
if one of a child's biological parent's is in prison, is it possible, without adoption & without the permission of the incarcerated parent, to just have the last name of said child changed legally with only the consent of the parent not incarcerated...? In the state of CO...? If a person goes to prison they should, in all honesty, forfeit their parental rights... I believe the law is on my side in regards to this matter... I would not be a dumb *** and get sent to prison to begin with... if I were in prison, I would not expect to have a say in a child I donated sperm to and then never supported (how could I support them, I'm in prison) and I sure as **** would not expect the other parent, the responsible one involved solely for raising the child that I donated sperm in order to help create, I would not expect that parent to force the child to keep a name so that child would have no choice but to be somehow associated with me, even if only in name alone, for the rest of his or her life... why would anyone want to share the name of some worthless bastard in prison...? I think it is possible without the incarcerated parent's permission, especially since you have sole custody. Good Luck! you could change it, if when u went to do so u filed as a single parent! so if u and the parent who was incarcerated maybe werent together anymore then u would be able to change the name! they may ask for the consent of the other parent but if u said they were no longer a part of urs or the childs life then legally u could change it!! It doesn't matter if the other parent is in prison, he will still need to be notified of your Petition to Change Name. |
