General question on child support?


I understand that I need to speak to a lawyer but I'd also like a little background info. My boyfriend of 4 months broke up w/ me when he found out I was pregnant. He wants me to give the child up for adoption, I want to keep it. He says he's too young (23) to raise a kid and "not ready." So here's the question: I am about 8 weeks along right now, how and when do I go about getting a paternity test? I absolutely know he is the father, but I believe that a paternity test is required in order to collect child support, no? Who pays for the paternity test? There is no way he can fight me on this is there? He just doesn't want to physically be there for the child, but he still has to pay right?

He sure does have to pay regardless if he wants to be there for the child or not! Go to your childsupport enforcement building and ask questions, they should be able to help you. I dont know where you're from but I know that in NJ the father does not need a paternity test in order to pay child support unless he denies the child. If the father denies paternity the court will order the test. If you are on welfare the court will pay for the child support, if not I believe that the father will be ordered to pay for the test being that he is the one who denies. You can probably go to google.com and type in "child support in (the name of your state)" It should give you some information.

There is no way at all until the baby is born for you to. After, the CSA can make him take one through the courts. He will still have to pay, but i think a child needs their father.

鈾?Once the baby is born request a paternity test through the courts. Honestly I'm not sure who will have to pay for it. But you are right in saying that paternity needs to be established in order for him to pay child support. The only way he wont have to pay is if he gives up complete parental rights to the child... My niece was in a similar situation two years ago.

If he denies being the father and the paternity test says otherwise, he pays for it. If the paternity test says he is not the father, you pay for it. Both parties put up money in escrow to handle either eventuality (with one party getting his/hers back).

Her baby's father was exactly the same way. The court essentially said, "too bad. shoulda worn a condom." He's now paying child support for the next 18 years (16 now).

You get a paternity test after and who pays for it will be determined in family court - the same court that will give you child support. He does have to pay - you make a baby and you support it. If he wanted a for sure that there wouldn't be a baby he should have been better protected.

legally yes he has to pay but seriously, how dare you force this man to pay for a child he told you he wasn't ready for. Your poor child will suffer because of your irresponsibility. If you can't afford to raise a child, why the hell are you having one? Does this not make sense to you? Poor guy. I hope the best for his future because I'm sure because of you, it won't be too bright. Say hello to being in poverty for the rest of your lives and ruining the futures of you and the guy.

You would get the test after the child is born

you will likely need a court order, depending on where you live, to compel him to take the test if he does not "volunteer" for it. This will require you to get an attorney, of course.

If he has no income (student) or is self employed don't fool yourself into thinking you are getting a lot of help. He can also dodge this for a time by moving to another state (and not letting you know where he is)

If you are his age or younger you may want to consider adoption - it is a tough world when you don't have both parents pulling together

I have many years of experience in this field, this is a very simple answer.

Yes, paternity MUST be established in order to obtain a child support order. This can be done by his acknowledgement by signing the birth certificate or, if he doesn't cooperate, by DNA testing.

As to who pays for the test, that depends on how you choose to establish your child support order. Typically, if you go through your local child support agency, they will help pay or pay in full, the cost of the test. If you go about it judicially (through the court system), that will be left to the judge, although from my experience, I've seen most judges order the father to pay for the cost of genetic testing and this is done when the child support order is established.

Once paternity is established, you can then have your child support order established, again this can be done judicially or administratively (child support agency).

No, he cannot fight you on this, except to skip the DNA testing appointments, but eventually, that will catch up to him. Federal law mandates that he pay child support, the only way out of it for him would be to terminate his parental rights and that is a matter that differs in each state.

This man is obligated to help support the life he created, if he will not live up to his responsibility, he will have to be forced, so be it. Good luck to you.
