Courtroom request?


is it possible to have your last name confidential and not mentioned during an adoption case in a courtroom? (adopting a little girl to become the legal father being that i may be marrying the daughter's mother) I wouldnt want the biological father to know my last name for security reasons. Any last name can easily be found.

I don't believe so but you might be able to get the transcript of the courtroom sealed so he can't read it.

While the proceedings are sometimes closed, the record is not. The fact is, the biological father has a legal right to know who is adopting his child and that right will manifest itself in the summons to appear that is REQUIRED notice under law.

If you do not send him a summons of pending action, you will either not be allowed to adopt or the adoption will be overturned as fraudulently obtained.

As per your email: While I agree that if the above situation is in regards to a Termination of Parental Rights petition, even during such a hearing the defendent must be notified of the proceedings.

If the rights have previously been terminated (and there is no indication they were in this post) then notice is not required. However, one does not lose his (or her) legal rights simply because someone wishes it.

TO THE POSTER: The ONLY way you can keep your name out of the adoption proceedings is not to adopt. This opinion is based on the tier of fact you present. There is no other information forwarded that would change that opinion.

IF, as Legally Brunette wants to believe, the father's rights have been PREVIOUSLY terminated, then notice is not required. However, unless there is grounds to close the adoption hearing (and by grounds the matter is one of fact for the judge to decide) they will be held open.

so, unless you have additional facts, my answer stands.
