Child support can they ?

if im rec'ding child support and my hubby sign adoption for my baby girl would they stop my child support ?

YES. Adoption means that the parent wanting to become the father/mother takes on ALL rights and responsibilities of the child, in the biological fathers place.

This means that...if you split up with your new husband AFTER, the adoption, HE will have to pay child support, HE will have to raise the child if you die etc.

All biological rights will be taken away from the real father and placed upon the adopted fathers head...unless the real father adopts the child back. How likely would that be, if given away once?

The new hubby must be VERY sure of you before he adopts or he could end up paying for a child that isnt his until it turns 18, via child support, if you divorce.

yes

yes after the adoption goes through but the father that is paying the child support has to sign the papers too.

yes they shore would

Once the biological father agrees to the adoption, and your husband adopts her, his obligation is over and you will no longer be eligible for child support.

Yes they would stop it. Because now your husband would be the legal father. You would have to get the ok from the biological father to give up all his rights to the child first. If he gives up rights and your husband becomes the adopted father, your husband would then have the responsibility of taken care of the financial burden of the child.

Probably. Check with Social Services.

only if it was agreed by both parties that him giving up his rights to the children was a condition of him no longer paying support.

is the genetic father giving up all rights to the child? have you called the child support division, they might be able to clarify this, i believe there are criteria. most likely, if he adopts the child, he will be responsible to pay for the child now. good luck

If your new husband adopted your child, he becomes the father and the biological father becomes a nobody. You can't collect child support from nobody.
