HELP! Can't find sons bio-dad to serve papers for termination!!?


My toddlers bio-dad has never had an interest in my son and is TERRIBLE news.. is just going through a case now for kidnapping the mother of another one of his babies. So my wonderful husband wants to adopt him and we're now to the point where we have to find this guy to serve him papers to sign away his rights (lets hope he does). But he's moved out of his parents and living with somebody else but his parents won't tell me where or if he works and his sister made it very clear that they don't want to help me at all (I wouldn't let them see him about a year ago because my sons dad was threatening me.. wasn't happy with their contact with my son).
I don't know what to do! What happens if we can't find him? Is it easier or more expensive or what? We really want to do this adoption ASAP! I am so stressed, I just want to be rid of these people!

I have been searching! I don't know how to find him! I haven't had contact with him in a LONG time!

If you haven't already hired an attorney, do so now. You will need to make service in a way that is reasonably calculated to give the putative father actual notice of the proceedings. This may be accomplished by publication and/or by serving his last known address (his parents).

If he has not supported not contacted the child for 1 year (statute of limitations varies state-to-state) then the court may terminate his rights to allow adoption without his permission. You will need proof of service, however, as he is entitled to the chance to explain his non-interest in your child.

Search for the biological father of the child because his consent is needed for adoption and custody purposes.

April, don't you just love it when family protects their loser sons, and siblings do the same thing. That's exactly the reason why men end up being couch surfers. I would would my son to the wolves.
Anyway, do some of your own investigating first. You need to be SLY. OK What line of work does he usually do? What night spots does he usually hang out at? What if any, type of information do you have on him such as ID. Does he go home for the holidays? Its really a matter of time before he shows up somewhere. Are there any warrants for his arrest?
