Our gen'l contractor recorded a mechanic's lien despite giving us an unconditional lien release - What now?


Our general contractor agreed to provide us with unconditional lien releases from all subcontractors, and reduce his final invoice by $5,000.

He ultimately failed/refused to provide the subcontractor lien releases, but gave us both a conditional and an unconditional for himself before having received the final payment.

When asked about the releases and our contractual 'final walkthrough' to identify issues with the property, he then threatened us for the final payment, to charge us $150/hr administrative fees to get the liens, 'revoked his offer' as he put it to reduce the final invoice, and filed a mechanic's lien.

The recorder's office said we could not actually record the unconditional lien release to prevent him from recording a mechanic's lien, but to 'keep it for our records.'

Now what are we supposed to do? I know for a fact that at least one subcontractor has not been paid, and we don't know all the names of the subs and apparently they can file late liens (past 20 days)..

Get a lawyer. Don't wait.
