Is she entitled to her vacation hours?


My friend worked at a company for 8months. They put her on administrative leave after another co-worker lied & said she did something. They didnt give her a chance to explain & told her to go home & send in an email by the end of the week with her side of the story. She did & never heard a word. She still has the health insurance & still gets a check every 2weeks for $0. She has called & emailed her boss with no response. Its been 2months. She has talked to other coworkers that have admitted they handled it wrong. Is she entitled to the 100hrs of vacation, sick, personal & legal time she accrued?

i would recommed that she talk to someone from the department of labor. tell them what happened and let them direct her. also she may want to seek an attorney for being wrongly fired. unfortunately, if you don't work for a company that has union representation you can be fired for anything and they can lie and pull little tricks to justify the fireing. great thing with unions, you have more rights and its harder to get fired. wish more jobs had them. unions that is.
but, if she can get some of the people on the job on her side, and are willing to submit letters that have been notorized she may have way to file a suit. good luck to your friend. dept. of labor can help with the info on being eligilble for the vac, sick pay.

This may be one of those companies that will terminate "at will", no explanation or anything. Now if the co-worker lied she may need to seek leagal advice from an attorney because it sound as a "unjust cause" termination. Most employers, not all, allow you to earn vacation after 1year of service. If she's been getting a paycheck though is $0 its obviously mean she is still an employee it not payroll wouldn't generate a paycheck.

I believe she maybe because they're still sending her checks-that shows she is still employed. She could go claim unemployment. Doesn't sound like much but it will drive their tax up. She could tell them if she doesn't get a response she will assume she is laid off and will file unemployment. That may get their butts moving. But, if not go file and drive their taxes up. Depends on her employment agreement and the laws in her state. I'd hire a labor lawyer and probably sue the employer for wrongful termination and illegal employment practices.

In most states, at termination she is entitled to her vacation hours only.
