Administrative Issues / DUI / Statute of Limitations? |
Received DUI 15 years ago, attempted to fight it, lost by jury trial, but my d.l. was never suspended and I was never contacted by anyone (DMV, ADSAP or anyone else) to turn in my d.l. Went on about my way, and today, 15 years later, I receive a letter stating my d.l. has been suspended and I must attend ADSAP and take out SR-22 insurance. Dug into it a bit, and found out the county level misplaced the ticket for so many years and then found it and submitted it to the state level. It seems the county level is willing to drop everything, but someone at the DMV state level is fighting to make me serve my time. Is there a statute of limitations that could be upheld? The DUI was already off my record, but now they have put it back on there. Something just is not right. Statute of limitations does not apply as statute of limitations is the limit of time to commence prosecution. Additionally, the suspension should not have been a surprise to you as the judge would have said that in court. |
